The Separate Sphere Advantage: Lizzie Borden

I love historical true crime and I love family crimes. That’s one of the reasons why Book 3 of my series uses one of the staples of mystery fiction: The family gathering at the family mansion for the holidays (though usually, the mansion is haunted, which isn’t the case in my book). So it’s no surprise that I, along with many other people, have always been fascinated by Lizzie Borden and the Borden family murder. 

There have been countless films, TV shows, and mini-series devoted to unraveling the Lizzie Borden case. I dug up an older movie recently, a made-for-TV film dating back to the 1970s. The Legend of Lizzie Borden (1975) stars Elizabeth Montgomery (aka, Samantha in the 1960s Bewitched series) and follows the events of the murders of Andrew and Abby Borden (Lizzie’s father and stepmother) and trial and acquittal pretty much as many sources report them. The film adds another element, though — it gives a theory (that has been accepted by many) of how the crimes were committed.

The film also takes a definite stance as to whether Lizzie was guilty or not. Keep in mind that, technically, the case is still unsolved. There’s also a lot of controversy over whether the evidence really shows Lizzie’s guilt. This film takes the stance that Lizzie was guilty because she had all the necessary requirements that point toward guilt: means, motive, and opportunity.

But this film brings in also another element to the motive piece I found especially interesting. It didn’t really surprise me, considering the film was made at the height of the second-wave women’s movement in the 1970s. Part of the movement’s purpose was to bring awareness to women’s oppression in the past. We already know the 19th century was not exactly a time of freedom for most women. They were dominated by the ideology of the separate spheres which kept them confined to certain areas of life (home, family, children, church), and venturing outside of that was considered transgressive. 

For a young woman of Lizzie’s social standing (small town high society), those confines were present and oppressive. She and her older sister often complained to their father about not being able to go where they liked or do what they liked and of being chained to the house. Both unmarried, they lived with their strict father and stepmother with little or no money of their own and were expected to fulfill household duties assigned to them. The film doesn’t fail to bring this out in some scenes between the family and also in one interesting scene between the prosecuting attorney (who is dead-set on convicting Lizzie) and his own wife (who, much to his chagrin, shows sympathy for Lizzie’s situation).

But could it be the separate spheres actually worked in Lizzie’s favor during the trial? This is a theory many sources put forth and the one the film supports. Since Lizzie was a well-respected, well-to-do young woman, active in her church and high society, and, of course, a woman, she couldn’t possibly have committed such horrendous crimes as to chop up her father and stepmother. Many believe Lizzie was acquitted not based on the evidence but based on who and what she was and the jury’s refusal to believe such a woman could commit murder.

Impulses and Madness: The History of the Insanity Plea

This last month, in honor of the release of my book, A Wordless Death, I wrote a series of newsletters for my newsletter subscribers about the 1914 murder of a New York schoolteacher named Lida Beecher. You can read a little about that case here

One of the fascinating things about this case is that it brought to the forefront the insanity defense in court cases in the 20th century. The insanity defense is when the defense lawyers claim the defendant was insane at the time he or she committed the crime. The caveat is the defense has to prove the accused had no conception of what he or she was doing when he or she committed the crime and had no concept of the moral or legal consequences of that behavior. To put it simply: They have to prove the defendant didn’t know what he or she was doing at the time of the crime and that what he or she was doing was morally wrong with legal consequences.

The insanity plea has actually been around since the mid-19th century. It was first used in Britain when a man standing trial for attempting to shoot the Prime Minister was acquitted when the jury decided he was psychotic and acting under the belief that the Prime Minister was conspiring against him. The insanity plea was used rarely throughout the years until the Leda Beecher case brought it back. In that case, the plea that Jean Gianini was innocent due to criminal imbecility (based partly on his results on the Binet test which found him to have the mental capacity of a ten-year-old even though he was sixteen) was accepted by the jury and Gianini was saved from the electric chair. Not that his fate was much better, as he was confined to a mental institution until his death in the 1980s.

The difficulty of the insanity plea is obvious: Is the defendant really insane with no concept of right or wrong or that he or she had even committed a crime? Or is the defendant just putting on a good show? The controversy over the insanity defense stems from this, as many people believe most are shamming. Take the film Anatomy of a Murder (1959), which was based on a real case that occurred in 1952. In the film, an army lieutenant is accused of shooting a man who had raped the lieutenant’s wife. The defense uses the plea of “irresistible impulse,” a variation of the insanity plea. In the film, we see the defense attorney constantly coaching the defendant on what to say and how to behave to convince the jury of his insanity. And it ends up working. Like Gianini, the lieutenant is saved from the electric chair. 

We see the insanity plea used so much on TV and in films (because it makes for great drama) that we might think it’s used very often. In the early 20th century, when my Adele Gossling Mysteries takes place, it was used quite a bit in court cases. But in the 21st century, we’ve gotten wiser and perhaps more cynical. In fact, the insanity plea or a variation of it is used in less than one percent of court cases. And of those one percent, only about a quarter are accepted. It all boils down to whether juries are buying that someone, even if they are mentally ill or emotionally unstable, could really not comprehend either what he or she is doing or that what he or she is doing is wrong. Those cases where the plea is accepted usually show the defendant as having a long history of severe mental illness.

The Second Wave Women’s Movement (1960s-1980s)

This is the inaugural issue of Ms. Magazine from 1972. How many of those article headlines apply to us today in 2021?

Women’s Equality Day is today and we want to celebrate!

It’s been a slow-going process for us to gain equality and even more slow-going to define for ourselves what that really means. The Merriam-Webster dictionary defines equality as “the state of being equal” (not very helpful, is it?) The word “equal” is defined as “of the same measure, quantity, amount, or number as another”. So equality is about sameness, right? It’s no wonder why many women (including one of my favorite musical artists, Kate Bush) mistake feminism for “wanting to be just like men”.

But from the beginning of its roots, the women’s movement was never about being “the same as men”. Suffragists wanted the vote (which they got in 1920) not because they wanted to think and act just like men, but because they wanted a say in public policies that affected them specifically, such as property laws, sanitary childbirth methods, and respect for their womanly virtues. 

But what’s more ironic is second-wave feminists defined equality as anything but sameness. The movement was, in fact, a highly personal one. It’s no wonder the feminist slogan became “the personal is political”. It grew out of mid-century women’s realization they were not living in a vacuum. Betty Friedan’s book The Feminine Mystique (which I talk more about here), was inspired by personal stories of the women she interviewed for women’s magazines in the 1950s, suburban housewives who had every material comfort but had lost their voices and their souls in the bargain. Again and again, Friedan heard tales of discontentment, anger, oppression, and guilt from these women which mirrored her own feelings. When the book was published, other women gathered in consciousness-raising groups and shared stories with one another. It was their desire to seek change for themselves and their sisters that sparked the movement.

In essence, the second-wave feminist movement begins where the suffragists left off. Suffragism (the right to vote) was what Victorian and Progressive Era women needed, a voice in the public sphere. Second-wave feminists of the 1960s took that voice to the next level. They identified issues affecting all women and lobbied for changes. For example, at the top of their agenda list was workplace discrimination. Issues such as affirmative action for women and abolishing segregated help wanted ads, which allowed employers to advertise jobs for women that they felt were suited to them based on gender, helped women get better jobs. This was a political stand, to be sure, but it was also a highly personal one that affected individual women’s lives.

Another issue of concern to women at this time was reproductive rights. The Pill was approved by the FDA in 1961, which was a major step forward for women. It gave many women the right to hold off having children until they (and not society) were ready for them. It also meant women who preferred to focus on a career and not have children could do so. They helped put the decision to “fulfill a woman’s role” (in conventional terms) in the hands of women and not men.

The second-wave women’s movement wasn’t all roses and chocolate, though. Within the movement, women didn’t always agree on what they should be fighting for. For example, Friedan became the first president of the National Organization for Women (NOW) in 1966 but stepped down four years later because she felt the increasing radical views coming from younger feminists didn’t gel with her own. NOW felt Friedan’s fight for working women wasn’t as high on the feminist agenda as she thought it should be.

In addition, women of color saw the movement dominated by middle-class white women and the issues most relevant to them neglected. They felt their experiences, especially with racism and classism, were overlooked and that separating discrimination by sex and by race was defeating the purpose of abolishing discrimination entirely. While there were many strong voices for women of color and their unique experiences (such as bell hooks and Angela Davis), they tended to be attached more to the civil rights movement than the feminist movement. Other women as well, such as working-class and LGBT women, pointed out the exclusion of issues more intimately related to them for those that affected their white, middle-class, educated sister more.

These omissions are, in fact, what the third-wave feminist movement (roughly, from the late 1980s to today) is about. That movement expands not only to all issues affecting all women personally but around the globe, which is why the movement has also been called “global feminism”.

Why I Love (And Write) Women’s Fiction

If you would ask me what is the genre of the Waxwood Series, I would unhesitatingly say “women’s fiction”. This is in spite of the fact that False Fathers, Book 2 of the series, is actually about a young man’s coming-of-age. The series itself focuses on the journey of one young woman to emotional and intellectual maturity in the last decade of the 19th century. Women’s fiction is always about journeys and all of my fiction, regardless of genre, even my upcoming historical cozy mystery series, the Paper Chase Mysteries, is about women’s journeys.

But is women’s fiction only about the gender of the author?

Different authors define women’s fiction (whether they write it or not) differently. My definition of women’s fiction is fiction where a woman goes through some kind of emotional and psychological journey and transformation, usually the main character or one of the main characters. That transformation doesn’t necessarily have to be a positive one, but one in which she learns something about herself and the world around her. And the book doesn’t have to be written by a woman either. I consider books like Leo Tolstoy’s Anna Karenina and Gustave Flaubert’s Madame Bovary women’s fiction, because the woman protagonist of each book goes through her own journey and transformation (however tragic), and we learn something about human nature and women’s lives in the nineteenth century. 

This last element is really why I love reading women’s fiction. The genre not just about women written for women and only relevant to women. It’s relevant to all our lives, male or female, or however you identify your gender. They also teach us about how women behave and are treated, and this reflects on the way human nature works in our patriarchal society, then and now. I make no secret of the fact that I don’t read many contemporary books but a few months ago, I picked up a book firmly placed in the contemporary women’s fiction category by K. L. Montgomery titled Fat Girl. Montgomery is a body-positive advocate and her protagonist is a plus-size woman whose trials and tribulations with romance, divorce, and raising a teenage boy speaks to our time with the struggles of single parents and body shaming in our weight-conscious society.

In the Waxwood Series, Vivian’s transformation continues throughout the Waxwood Series and will be completed in Book 4. Her revelations about family, women and social expectations will hopefully speak not only of the paradoxes of the Gilded Age but also our time.

Complex Woman and Man in The Misfits (1961)

A few weeks ago, I had the opportunity to review a book about classic Hollywood film director Robert Wise (you can find that blog post here). Reading this book reminded me of how much I used to love blogging about classic films. I haven’t done that in the last few years because I wanted to focus more on history related to my fiction, but the Wise book got my juices flowing again, so I’m putting classic film blogging back on my agenda.

Since this is Women’s History Month, and I’m celebrating the accomplishments of women in the 1950s and 1960s, I thought it would be fitting to blog about one of the most iconic movie stars of the mid-20th century who still haunts us today — the beautiful, talented and troubled Marilyn Monroe.

Monroe is best known for comedies in the 1950s such as Gentlemen Prefer Blonds (1953) and The Seven Year Itch (1955). But she also did a fair amount of dramas and excelled in them. In 1961, when she was married to Arthur Miller, she starred in The Misfits and gave what I consider the finest performance of her career. The film is a magnificent classic written by one of America’s premier playwrights (Arthur Miller) and stars, along with Monroe, some of Hollywood’s greatest actors (Clark Gable, Eli Wallach, Montgomery Clift, and Thelma Ritter). What fascinates me the most about this film is the way both Monroe and Clark Gable edge out of the kind of roles they had been used to playing for much of their careers.

I don’t think anyone would deny that, when it comes to the feminine prototype, Marilyn Monroe’s film persona is it. From her voluptuous figure to her child-like voice to her sensual gazes, Monroe embodied a fantasy for 1950s men that differed widely from the woman of the Occupation: “Housewife” era. The sensual babydoll was no weakling, though. She was in command of the men who admired and lusted after her, aware of what she had to offer as a woman and making the most of it. Similarly, Gable was the definition of masculinity in the 1930s and 1940s. His elegant pencil mustache and gruff manner and his readiness to throw a punch at any given moment defined what it was to be a “man’s man” not only in the pre-World War II era but in the years following the war.

In “The Misfits”, Monroe is something of the innocent but voluptuous baby doll while Gable is the gruff cowboy capable of bringing women to their knees even in his 60’s. But the characters they play are much more complex and move well beyond these stereotypes. Monroe shows us the darker side of the sexy babydoll that so captured the delight of 1950s viewers in films such as those mentioned above. Miller wrote the character of Roslyn Taber with Monroe’s own past in mind, and some of the more troubling aspects of Monroe’s life emerge in that character. One is Monroe’s paradoxical relationship with her mentally ill mother. In a scene following Taber’s divorce settlement, she becomes tearful thinking about her mother. One can imagine that, during this difficult time, Taber has a sudden wish for the maternal comfort she never got, and one wonders whether Monroe herself didn’t sometimes have the same wish for her mother, who was largely absent from her life, in and out of mental institutions.

As for Gable, the character of Gay Langland is much less pugnacious than some of the characters Gable played in the 1930s and 1940s. For example, in one scene, he assures Taber she might someday think of him as something more than a friend in such a good-natured way that it’s clear Langland isn’t a man who expects every woman to fall for him, and that his ego doesn’t depend on this. The man of iron also shows himself as vulnerable as the film progresses. In one scene, his drunken devastation at being unable to find his estranged grown children at a rodeo gives us a glimpse into some of his past regrets.

The 1960s, when The Misfits was made, was a time when the rigid definitions of the post-war gender roles were beginning to break down, which, I think, partly accounts for the way Taber and Langland are portrayed in this film.
